Go Here For Missouri DWI Criminal Penalties
If your license is suspended or revoked you can apply for a Limited Driving Privilege after you have served a certain number of days of your suspension or revocation (depending on the nature of the suspension or revocation). Should you be granted the LDP, you can only drive for employment or other important matters.
When can I apply for a LDP?
Provided you are not otherwise ineligible to receive a LDP (see below), you can apply for a LDP:
- After the first 30 days of serving a suspension (oftentimes for receiving a DWI or BAC ticket)
- After serving of 90 days of a revocation for refusing to submit to a chemical test.
If you are eligible for a LDP you must have on file proof of insurance ("SR-22" Insurance) during the entire term of the LDP and must have completed SATOP.
You are not eligible for a LDP if you:
- Are eligible for reinstatement of your full driving privileges, but all reinstatement requirements have not been met.
- Have already received an LDP within last 5 years.
- Are convicted of a felony involving the use of a motor vehicle.
- Are convicted of leaving the scene of a motor vehicle accident.
- Have 2 or more revocations for refusing a drug or alcohol test.
- Have had your Commercial Driving Privileges (CDL) suspended or revoked. (You may receive a LDP for non-commercial purposes).
- Have been convicted for driving a motor vehicle under the influence of drugs.
- Have multiple convictions involving alcohol.
Serving a 5 or 10 year revocation?
If you are serving a 5 or 10 year revocation, you may still be eligible to receive a LDP following the first 2 years (in a 5 year revocation) or 3 years (of a 10 year revocation). Please contact our office if you have served this minimum amount of time on your revocation and we will gladly assess your chances at receiving a LDP.
Although we will charge you a fair rate for pursing a LDP in such situations, we will charge you nothing to assess your eligibility for such a LDP. Please contact St Louis DWI Lawyer Mark Dean for a free phone consultation (followed by a free 15 minute in person office consultation) at 314-872-2120 or 1-800-431-3212.
